TINJAUAN HUKUM PELAKSANAAN KEWENANGAN GAMPONG PADA DAERAH ASIMETRIS DI KECAMATAN KOTA JUANG KABUPATEN BIREUEN

Abstrak


High teacher Aceh is one of the 5 (five) asymmetric regions in Indonesia. If Jogyakarta is an area that has special rights, DKI, Papua and West Papua are areas that have special rights, then Aceh has both privilege rights and special autonomy rights, both from the aspect of authority and from the territorial aspect, receiving recognition in the legal system of the Unitary State. Republic of Indonesia, this form of recognition is regulated in the 1945 Constitution. The implementation of Gampong government policies will have an impact on the existence of activities whose implementation is financed by APBG. administration of government and statehood in every rule of law state, especially for rule of law and continental states.

  Based on the explanation above, the author focuses on in-depth research with the thesis title "Legal Review of the Implementation of Gampong Authority in Asymmetrical Areas in Kota Juang District, Bireuen Regency". And what are the factors that hinder the formation of the Gampong Qanun which regulates village authority in Kota Juang District, Bireuen Regency?

The research approach used in this study is a qualitative approach and the results of the research: The implementation of Gampong authority in Kota Juang District, Bireuen Regency has not been stipulated by the Gampong Qanun as the legal basis for governance in the gampong as ordered in article 24 of Permendes PDT Number 1 of 2015 and article 23 Permendagri Number 44 of 2016, as a result the implementation of government affairs and community interests which are the authority of the gampong in the field of governance, implementation of development, community development and community empowerment in the Kota Juang sub-district does not yet have a legal basis or principle of legal certainty as one of the principles of administering village government good governance as mandated in article 24 of Law Number 6 of 2014 concerning Villages. And the low capacity of gampong government apparatus, lack of facilitation, monitoring and evaluation from the superior government is an inhibiting factor that has not yet formed a Gampong Qanun which regulates gampong authority, training and technical guidance that has been held so far has not been able to provide solutions to the technical problems faced by the gampong government in formation of Gampong Qanuns other than the RPJMG and APBG Qanuns
